Um... the story in this case concerns a lady drank ginger beer in a restaurant bought by the other person. When she nearly finished the beer she found a snail at the bottom of the bottle. Afterwards she felt very sick in stomache, and was mentally distressed. She could not sue the owner of the restaurant because of the privity of contract. Instead she sued the manufacturer. By this neighbour principle formulated by Lord Atkin, the claimant lady was compensated for both the physical and psychiatric damage suffered.
