U.S. Dept. of Justice Strikes Down HBV Discrimination

The Hepatitis B Foundation is proud to have played a key role in the important decision that the U.S. Department of Justice (DOJ) made in making HBV-related discrimination an ADA violation. This is an historic and enormous advocacy success for those living with hepatitis B.

"The DOJ reached a settlement with the University of Medicine and Dentistry of New Jersey School (UMDNJ) under the Americans with Disabilities Act (ADA). The settlement resolves complaints that the UMDNJ School of Medicine and the UMDNJ School of Osteopathic Medicine unlawfully excluded applicants because they have hepatitis B. This is the first ADA settlement ever reached by the Justice Department on behalf of people with hepatitis B." Read the DOJ News Release

The two Asian American students involved in this settlement turned to the Hepatitis B Foundation for help, within one month of each other in 2011. When we learned that they had been told they could not start medical school, after having been accepted and moved to New Jersey, because they tested positive for hepatitis B during a routine physical examination, we responded immediately by reaching out to the CDC and then later to the DOJ with the assistance of Ms. Nadine Shiroma, a public policy professional.

These actions resulted in the CDC updating its recommendations for HBV-infected health care workers and students to state clearly that hepatitis B should not prevent someone from pursuing a career in health care that were published in July 2012. Now that the DOJ's settlement has set a legal precedent for addressing HBV-related discrimination as an ADA violation, there is even more protection for those living with hepatitis B.

"The DOJ settlement also calls for UMDNJ to adopt a disability rights policy based on the CDC's updated hepatitis B recommendations and provide ADA training for its employees. Given that the UMDNJ system includes eight schools on five regional campuses, the DOJ findings will not go unnoticed among medical, dental, and other professional health education institutions," noted Ms. Shiroma.

For more background on this story, read the Hepatitis B Foundation's  B Informed newsletter (Spring 2012).
